Several of our attorneys were part of the team representing a whistleblower in a False Claims Act Case against Mid Dakota Clinic, a medical group in North Dakota. The whistleblower alleged that the company set up an ambulatory surgical center, a health center aimed at outpatient and other same day surgeries, to capture referrals in violation of the Anti-Kickback Statute. The practice risks abuses such as physicians recommending unnecessary treatments or more complex than expensive surgeries than are appropriate because money can cloud medical judgment. See Becker’s.
