$2.6 Million Win, Kickbacks and Licensing Violations

Two of our attorneys represented whistleblower Elma Dresser, a sleep technician, in a False Claims Act case alleging that Bay Sleep Clinic and associated businesses fraudulently billed Medicare for conducting sleep studies and dispensing durable medical equipment from unapproved locations using unlicensed technicians. The case also alleged that Bay Sleep Clinic paid doctors for referrals in violation of the federal Anti-Kickback Statute. The government joined a portion of the case, and in 2016, the defendants agreed to pay $2.6 million to settle the matter. The whistleblower received $545,000, nearly 21% of the government’s recovery.
