AI: A New Type of Whistleblower?

Artificial intelligence (AI) is seemingly everywhere these days. It’s upending industries, driving record stock market returns, and, like all revolutionary technologies, generally disrupting our current world as it pushes us towards something new. Its power is both awesome and ever changing. Can AI one day become a whistleblower? Under the False Claims Act, whistleblowers can sue unscrupulous contractors on the government’s behalf, and potentially share in the recovery. The law has become one of the government’s most effective fraud-fighting tools and billions are recovered annually due to cases brought by whistleblowers. Both the DOJ and whistleblower already utilize various statistical analyses to detect and prevent fraud, but will AI eventually develop sufficient capabilities to, itself, become a whistleblower? Only time will tell. Read partners Hallie Noecker and Max Voldman’s recent Newsweek op-ed on AI and whistleblowing here.
